VANGUARD28 TRANSPORT SERVICES provides freight transportation, logistics, and supply chain management services. We act as a service provider arranging for the transportation of goods by independent carriers or our own fleet. 6. Shipping, Transit, and Liability
Bill of Lading: The Bill of Lading is the primary contract of carriage between you and the carrier. Our role may be as a broker arranging the transportation. The terms and conditions of the carrier’s bill of lading will also apply.
Title and Risk: You retain title and bear all risk of loss for the goods until they are delivered and signed for at the destination.
Transit Times: All transit times provided are estimates and are not guaranteed. We are not liable for delays caused by factors beyond our reasonable control, including but not limited to weather, mechanical failure, traffic, customs delays, or acts of God (“Force Majeure”).
Limitation of Liability: OUR LIABILITY FOR LOSS, DAMAGE, OR DELAY TO YOUR SHIPMENT IS STRICTLY LIMITED AS PER OUR STANDARD TERMS, WHICH ARE INCORPORATED INTO THE SHIPPING DOCUMENTS. UNLESS YOU DECLARE A HIGHER VALUE AND PAY AN ADDITIONAL SURCHARGE, LIABILITY SHALL BE LIMITED TO A SPECIFIED AMOUNT PER POUND OF WEIGHT (E.G., AS PER THE RELEVANT CARRIER’S TERMS OR APPLICABLE LAW). WE ARE NOT LIABLE FOR CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES, INCLUDING LOST PROFITS OR INCOME.
7. Claims for Loss or Damage
Any claim for loss or damage must be filed in writing with us within a specified period (e.g., 9 months) from the date of delivery (or the expected delivery date for lost shipments). You must provide all relevant documentation, including the original bill of lading, proof of value, and evidence of damage. Failure to file a timely claim will result in a waiver of the claim.
